1. Acceptance of Terms
By downloading, installing, or using TallyFit, you agree to these Terms of Use and our Privacy Policy. If you disagree with any part of these terms, you may not use our app.
2. Account Creation and Security
To use TallyFit's sync features and AI assistant, you need to create an account. You agree to:
- Provide accurate account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
3. Subscription Terms
TallyFit offers the following auto-renewing subscription options:
- Monthly Subscription: $7.99/month with 3-day free trial
- Annual Subscription: $59.99/year with 7-day free trial
Subscription terms:
- Payment will be charged to your Apple ID Account at confirmation of purchase
- Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
- Your account will be charged for renewal within 24-hours prior to the end of the current period
- You can manage subscriptions and turn off auto-renewal in your App Store Account Settings
- Any unused portion of a free trial period will be forfeited when purchasing a subscription
4. AI Assistant (Tally)
Our AI assistant Tally provides personalized workout recommendations, routines, exercises, and more. You acknowledge that:
- AI-generated content is experimental and may be inaccurate or incomplete
- We may modify, limit, or disable the AI service at any time for maintenance or other reasons
- Workout suggestions should be evaluated for personal suitability and health considerations
- AI responses are not professional medical or fitness advice
- Your interactions help improve the AI service, and you consent to such use
5. Data Sync and Storage
TallyFit provides cross-device synchronization. You understand that:
- Your data is stored on secure cloud servers (Firebase)
- An internet connection is required for sync features
- We maintain backups to reduce data loss
- You're responsible for maintaining local backups of any critical data
6. Health and Safety
By using TallyFit, you acknowledge that:
- Consult healthcare providers before starting any exercise program
- Exercise within your personal limits and stop if you experience pain or discomfort
- The app is not a substitute for professional medical advice
- All AI recommendations should be carefully reviewed for safety and suitability
7. User Content
For custom workouts and routines you create:
- You retain ownership of your content
- You grant us a license to store and display your content as needed to operate the service
- You're responsible for the content you create
- We may remove inappropriate or harmful content at our discretion
8. Limitation of Liability
TallyFit and its creators, affiliates, employees, or agents shall not be liable for any damages arising from or related to your use of or inability to use the app or the AI assistant, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages. This includes any injury, property damage, or losses you may sustain. You understand and agree that you use TallyFit at your own discretion and risk.
TallyFit is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the app or its AI features will be error-free, uninterrupted, or that they will meet your requirements or expectations. We disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the fullest extent permitted by applicable law.
9. Privacy and Data Protection
We protect your privacy according to our Privacy Policy. Using TallyFit means you accept our data handling practices. We do not guarantee absolute security of your data and disclaim liability for any unauthorized access or breach.
10. Changes to Terms
We may update these terms. Continued use after changes means you accept the new terms. Major changes will be notified in-app.
